It’s time for an Amendment

The big news in politics this week is the round of Supreme Court oral arguments concerning the constitutionality of the Obamacare individual mandate.

It seems patently obvious to me that the mandate is an overreach of legitimate congressional power, and anathema to individual liberty, but there’s no way of knowing how the Supreme Court justices will vote* or how they will rationalize their impending votes.

I’ve been particularly interested in the Institute for Justice’s take on the healthcare law as a violation of centuries of contract law — that is, a contract which an individual is coerced into entering is not valid or enforceable.

Regardless of the outcome, it’s time for there to be a clear line drawn to rein in the federal government. A good start might be Professor Randy Barnett’s Federalism Amendment idea.


* Except for the four liberals, who apparently never saw an expansion of federal “social engineering” power they didn’t like.
